OBJECTIVE

This website is the online store for the sale of products via the Internet (hereinafter referred to as the “Store”) of the company with the name “PAPADIMITRIOU ST. IOANNIS E.P.E.”, with Tax Identification Number 095477924, Tel. 2105762300, Konstantinoupoleos 25, 12132, Peristeri (hereinafter referred to as the “Company”) The terms of use of the Store are included herein in a clear, concise and understandable manner. Furthermore, any contract concluded through the Store is governed by the terms referred to herein as well as those, as the case may be, agreed between the parties. Any other terms are expressly excluded. Without prejudice to the principle of good faith and the principles of good business practices, as well as, in general, the provisions governing legal transactions, especially those concluded at a distance (where applicable), each user who enters and uses the services of the Store is deemed to consent to and unconditionally accept the terms set forth herein, without any exception. If a user does not agree with these terms, he must refrain from using the Store and from any transaction with it.

2. RIGHTS, OBLIGATIONS AND LIABILITY OF THE PARTIES

The Store may contain links or indications regarding other websites owned and managed by third parties. The Company does not operate or control and therefore bears no responsibility for any information, product or service contained therein. Therefore, for any problem that may arise during the visit or use thereof, you must contact directly the legal representatives of the said websites, who bear the relevant responsibility for the provision of their services. The Store may, for any reason and without notice, change these Terms but will make every effort to indicate any changes to these Terms with a notice on the home page. The continued use of this website by users after the effective date of any changes to these Terms will be deemed as acceptance by users of such changes.

The Company makes no representation that the information contained in the documents and announcements published on this server is suitable for any purpose. Any such documents and related graphics are provided “as is” without any warranty of any kind whatsoever.

The Company is not responsible or liable for any damage (including compensation for moral damages) resulting from the inability to provide support services.

By using the Store, the user declares that he agrees that the use is at his own risk and acknowledges that, although the Company makes every effort to provide high quality services, it is not possible to guarantee that there will be no interruptions in use or errors in the content of the store. The photos of the goods are indicative. The user may examine the goods in the Company's physical stores, with the proviso that the availability of a code may vary from store to store.

The user of the Store (which includes any person using the Store, with or without rights of use, with or without connection, as well as anyone liable under the law for the acts of a third party using it, e.g. the legal guardian or the legal guardian of a minor) declares that he is legally capable of entering into a contract with the Company through the Store, as well as to use the Store under the terms and conditions stated herein. Also, since the use of the Store is made after connecting to it with the User's login details, he accepts that he is personally and financially responsible for any use of the Store, even if the use of the Store is made by others, e.g. persons residing with him. The registered user agrees to prohibit any use of the Store by minors who use his account or his name.

The user is free to use the Store in accordance with these terms, the law and good morals. The responsibility for the contents of the transactions belongs exclusively to the user. The Company does not exercise any type of correction or intervention in the data transferred by the user, who must correctly complete the fields in the on-line communication forms.

The user agrees and undertakes not to use the Store for:

  1. Sending, publishing or transmitting in any way any content that is or may be considered for any reason immoral (offends good morals, social values, minors, etc.) or illegal or, in general, offends, harms or damages the Company or any third party and their legitimate interests,
  2. Sending, publishing or transmitting in any way any content for which users do not have the right to transmit according to the law or applicable contracts (such as internal information, proprietary and confidential information acquired or disclosed as part of employment relationships or covered by confidentiality agreements), as well as any content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of third parties or contains malicious software intended to interrupt, damage, destroy or disable the operation of any computer software or hardware,
  3. Any other intentional or unintentional violation of applicable legislation,
  4. Any collection or storage of personal data about other users.

Without prejudice to any other rights of the company, any use contrary to the above may result in the termination of the services provided without any notice. The user agrees that the management, employees, associates and shareholders of the Company are not liable for any breach of the above obligations by the User.

3. CONTRACT

In order to conclude a contract with the Company (e.g. purchase of goods) through the Store, registration in the Store (using a “username” and “password”) is not required. During the purchase process, the user will be asked to log in (if already registered) or to provide the details to which the goods will be sent. If the user wishes, he can either provide a password, and thus his details will be saved for future transactions, or not provide a password, in which case he will need to repeat the relevant details in future transactions.

For registration, only name, mailing address, contact telephone number and e-mail are required. This information remains completely confidential, in accordance with the detailed information in the paragraph herein concerning Personal Data.

Orders are placed in writing online by completing and sending the relevant form available in the Store. The contract is concluded when the user receives an order status update with the indication “Sent”. Other updates on the order status are displayed on the user's screen and are sent by e-mail to the contact email address registered by the user. During the processing of each registered order, the stock availability of the products ordered is also confirmed. In the event that the availability or delivery time differs from that indicated on the product page, the user will receive relevant information.

Before sending the order, the user, in addition to knowing the terms of this, also becomes aware of the following information:

  1. That the user's counterparty is the Company, the full details of which are listed herein, b. The main characteristics of the goods ordered, c. The total price of the goods, including VAT. and any other fee as well as, where applicable, all additional shipping, delivery or postal charges and any other expense, d. The payment, delivery, execution arrangements, the deadline within which the Company undertakes to deliver the goods, e. That the user may submit any complaint in any way and in particular by telephone at 2105762300 or by e-mail at info@papabross.gr and that the Company, after examining the complaint, will contact the user as soon as possible, f. that given the use of the internet as a means of distance communication for the conclusion of the contract, there is no charge to the user by the Company for the use of the Store, g. That the user has a right of withdrawal in accordance with the conditions, deadline and procedures for exercising the right mentioned below, h. That the Company is liable for actual defects and lack of agreed properties in accordance with articles 534 et seq. of the Civil Code, as well as that the Company provides further commercial warranty and user support services after the sale, in accordance with the terms mentioned below.

The Company bears no responsibility and does not cover differences in the prices of products purchased from the Company's physical store and the user subsequently discovers the existence of a lower price in the Store or vice versa.

Any product offers are valid until stocks last.

The Company is not responsible for any errors in the characteristics, photos and prices of products listed in the Store and cannot guarantee that there will be no errors for any reason when entering and/or updating the characteristics and/or price of a product. For this reason, in the context of good faith, if the user finds that a good is offered at an unusually low or high price in relation to its market value, before proceeding with his order, he must contact the Company by e-mail at info@papabross.gr

The Company provides the ability to order the goods available through the Store. The user has the ability to select through the Store the good(s) he/she wishes to purchase as well as the store where the purchased product will be received, paying the purchase price in cash or by card upon receipt of the goods at the physical store he/she has chosen. The said order will be valid from the moment the user receives an e-mail informing him/her of the dates of receipt of the order from the physical store and for the period indicated in the said e-mail. If the user does not come to the store and pay the price within the aforementioned deadline, the order will be canceled, without the Company being liable for this reason. If a user abuses this option (e.g. repeated order without receipt from the store), the Company may reject and refuse the order.

According to Directive 2013/11/EC, which was incorporated in Greece by JMD 70330/2015, the possibility of electronic resolution of consumer disputes through the Alternative Dispute Resolution (ADR) procedure is now provided for throughout the European Union. If the customer has the status of a consumer (i.e. a natural person acting outside his professional capacity) and has any problem with a purchase made from our Website, he can initiate the ADR procedure through the single pan-EU platform for electronic dispute resolution (ADR platform).

4. INTELLECTUAL PROPERTY

The Store contains intellectual property material that belongs to the Company and is protected by law. All contents of the Store are intellectual property of the Company (or third parties contracted with it) and are protected by Greek and international legislation. Any copying, reproduction and retransmission of the material is prohibited without the written permission of the Company. In particular, the intellectual property rights of the content of the Store, including, without limitation, all documents, files, texts, images, graphics, components and the code contained therein as well as the general image of the Store, constitute intellectual and industrial property of the Store unless otherwise specified and are protected by the relevant provisions of Greek community and international law. The appearance of this material in the Store in no case implies a transfer or assignment of a license or right to use them.

The Store authorizes users to copy and print excerpts or documents from this website (except for content owned by a third party and designated as such) for their own non-commercial use, provided that any copy or excerpt of such documents or pages obtained retains all copyright or other proprietary notices and any disclaimers contained therein. Except for this limited license, nothing in the Store should be construed as granting any other right or license under any copyright, patent or trademark of the Store and the Company or any third party. All of the Store's logos and trademarks may not be used or reproduced without the prior written consent of the Company. Unless otherwise specified, commercial copying, modification or reproduction of part or all of the contents of this website in any form, based on it and/or its content, or incorporation into other websites, electronic retrieval systems, is prohibited. No link to the Store may be included on any other website without the prior written approval of the Company.

5. INVOICING – PAYMENT OF PRICE

Users can be billed either by a retail receipt, delivered upon delivery-receipt of the goods, or by an invoice, if the user is a freelancer or a commercial enterprise.

For product shipments within Greece, the user can choose as a payment method cash on delivery, bank deposit or credit card. In the case of choosing cash on delivery, the user is obliged to pay the total amount to the post office or to the courier employee who will deliver the package. In the case of choosing credit card, a corresponding charge will be made to the user's card account.

Transactions made by credit card through the Store will appear on the user's credit card account with the reason “PAPADIMITRIOU ST. IOANNIS S.A.” In the event that it is proven that a third party's credit card has been fraudulently used through no fault of theirs, this charge may be cancelled upon request to the Bank that issued the credit card, which must investigate the complaint. For this reason, any injured third party is obliged to immediately notify the issuing Bank as soon as they become aware of this event, so that it can be cancelled and its use by unauthorized persons can be excluded.

In both cases, a refund is made if the user decides to return the product. In cases of cash on delivery, the user receives a check on the same day, in cases of purchase via credit card, the card is immediately credited.

Product shipments outside Greece are made only by courier and credit card charge.

6. DELIVERY – TRANSFER OF OWNERSHIP AND RISK

The goods can be shipped by the Company anywhere, to the location indicated by the user in the order form. Shipping costs depend on the total weight of the order and the shipping method.

The Company will make every effort to ship the products, within Greece, within 1-3 working days (Monday to Friday), for deliveries by courier and within 8-10 days, for deliveries by post. The maximum delivery time cannot exceed 30 days.

The Company shall not be liable for delays in performance (including delivery) due to circumstances beyond the Company’s control or due to force majeure and the Company shall therefore be entitled to an extension of time for performance. Force majeure means any event beyond the Company’s control which it could not have foreseen or prevented and which results in the Company’s inability to fulfil, in whole or in part, any of its obligations under the contract. If such circumstances continue for more than one month, the contract may be terminated by either party without compensation.

In any case of delay in delivery beyond the agreed time, the user must request the Company to make the delivery within an additional period proportionate to the circumstances and only in the event that the goods are not delivered within this additional period, the user is entitled to terminate the contract. The above does not apply when delivery within the agreed period is important, taking into account all the circumstances surrounding the conclusion of the contract, or if the user has informed the Company, before the conclusion of the contract, that delivery is required to be made on or by a certain date. In such cases, if the Company fails to deliver the goods at the time agreed with the user, the consumer is entitled to terminate the contract immediately. Once the contract is terminated, the Company must refund, without undue delay, all money paid under the contract.

Ownership of the goods is transferred upon full payment of the price. The risk of loss of or damage to the goods passes to the user when he or a third party designated by him and other than the carrier has acquired physical possession of the goods. However, the risk passes to the user upon delivery to a carrier if the user has requested that the goods be carried by a carrier of his choice and this has not been offered by the Company (without prejudice to the user's rights against such carrier).

7. WARRANTY

In the event of the Company's liability for a real defect, the user is entitled, at his option, to a) demand, without charge, the correction or replacement of the product with another, unless such action is impossible or requires disproportionate costs, b) request a reduction of the price or c) withdraw from the sales contract, unless it is an insignificant real defect. In order for a property to be considered agreed upon, it must have been agreed in writing. If the buyer chooses to correct or replace the product, the Company must proceed with the correction or replacement within a reasonable time. The above rights of the user expire after two years for movable property.

8. RIGHT OF CANCELLATION, RIGHT OF WITHDRAWAL AND RIGHT OF REPLACEMENT

The user may, using any means of communication, cancel an order placed by any means of communication, so that it will not be executed, provided that it has not already been executed (orders that are in the “Pending” or “Processing” or “In Progress” stage).

The above applies to orders placed through the online store, by phone or any other means of written communication, even if you selected pickup from a specific store as the delivery method. For purchases made through our network of stores, you can only exchange the product for another product and not receive a refund.

The rights of cancellation, withdrawal or replacement should not be confused with the case of defective goods, as these are covered by their respective warranties and the official brand representatives are responsible for their replacement.

The goods can be shipped by the Company anywhere, to the location indicated by the user in the order form. Shipping costs depend on the total weight of the order, the shipping method and the country of destination.

WARRANTY

In the event of the Company's liability for a real defect or for a lack of an agreed property of the good, the user is entitled, at his option, to a) demand, without charge, the correction or replacement of the product with another, unless such action is impossible or requires disproportionate costs, b) request a reduction of the price or c) withdraw from the sales contract, unless it is an insignificant real defect. For a property to be considered agreed, it must have been agreed in writing. If the buyer chooses to correct or replace the product, the Company must proceed with the correction or replacement within a reasonable time. The above rights of the user expire after two years for movable property.

The Company provides a commercial guarantee of good operation and free repair in the proprietary service, which ranges, depending on the good, up to 2 years, from the acquisition of physical possession of the good. The guarantee offered for each product is indicated in its detailed description. After the expiry of the guarantee period, repair services are offered at very reasonable charges for the entire life of the product. The Company does not provide a guarantee, nor does it guarantee protection for the suitability of the product sold for any specific purpose.

The commercial warranty covers the free repair of the goods (labor and spare parts) from normal use. Damage from incorrect handling, force majeure and generally harmful external factors are not covered. The user is responsible for the cost of transportation to and from the repair shop, whose visit to the user's premises is charged additionally. The warranty does not apply in the event of intervention by an unauthorized technician. We inform you that PAPADIMITRIOU bears no responsibility for any damage and wear and tear of the products after their use and is under no circumstances obliged to replace them. The agency itself is solely responsible for the replacement of products and any form of product repair.

The user may, within 14 calendar days from the delivery of the goods to the user (or delivery to a carrier chosen by the user other than the one offered by the Company), withdraw from the contract concluded with the Company (i.e., for all goods of each order). The Company will in this case refund to the user all the money received from him (by credit to his debit/credit card account or via PayPal, provided that he used it for the transaction, otherwise by a check sent to him by post) - in any case, no costs will be charged for such refund - including, where applicable, delivery costs (excluding additional costs due to the user's possible choice to use a delivery method other than the cheapest standard delivery method offered by the Company), without undue delay and in any case within 14 calendar days from the day the Company is informed of the user's withdrawal (via email, telephone or return slip). The user must, in this case, return the goods to the Company by means of his choice and at his own expense, without undue delay and in any event within 14 calendar days from the day on which he declared his withdrawal from the contract. The user is only liable for any reduction in the value of the goods resulting from handling that was not necessary to determine the nature, characteristics and functioning of the goods. In simple words, the goods must be in a condition that allows their resale, so you can try the goods on, but not use them. No parts have been removed from the bracelet to adjust it to the user's wrist or any kind of modification has been made. For example, if you bought a watch, you can try them on at home, but not wear them outside. The returned item must, in addition, be exactly as it was before the sale with the change tag still attached, in its full original packaging (box, nylon, foam, which should not have any tears or damage/alterations) and with all the contents of the original packaging (instructions for use, features and warranties, connection cables, installation software, etc.). The Company is entitled to delay the refund until it receives the goods back or until the user provides the Company with proof that he/she sent the goods back, whichever occurs first. The user may return the item himself/herself to the Company's headquarters or to any of its physical stores. An item that was sold with an additional gift must be returned together with the additional gift, otherwise the value of the gift will be deducted from the refunded amount. Otherwise, the current provisions of Law 2251/1994 on withdrawal apply.
